年銷售額超過48萬元的跨境電商，只要有銷售予境內自然人之電子勞務者，從今（2017）年5月1日起必須在台辦理營業登記並繳營熱門業稅。財政部初估首年稅收9億元、各大線上訂房網將首當其衝受影響。財政部日前也修正裁罰規定，跨境電商或其稅務代理人，若未依規定登記繳稅，首次、第2次被查獲都罰3千元，第3次後依次罰3萬元。

財政部去年已修法，要求在國內沒有任何固定營業據點的跨境電商，必須比照國內企業，若年營業額超過48萬元，就得自行或委託報稅代理人，向國稅局辦理稅籍登記並繳納5%營業稅，首年稅收預估為9億元。

財政部指出，近年國際間針對跨境銷售勞務議題修改加值稅規定之國家，如南韓、挪威、日本、紐西蘭及澳洲等，多半都立法要求外國業者辦理稅籍登記，且標準也多與國內業者相同。

財政部賦稅署主任秘書謝慧美表示，亞洲各國在營業稅登記門檻規定中，雖然日本門檻稍高、國內外皆為1千萬日幣，但南韓門檻為0，全部境內外電商都需登記，而台灣的48萬算是介於中間值。

謝慧美指出，財政部在違規罰則上，也大致比照國內企業，5月新制上路後，跨境電商若違規未申報，須處3千元以上、3萬元以下罰鍰。1年內首次、第2次被查獲都罰3千元，第3次後依次罰3萬元。

謝慧美認為，這次針對跨境電商銷售境內自然人的電子勞務部分課稅，首當其衝的對象可能是訂房網或是線上貼圖交易，她也坦言，這部分的稅金在稽徵上難度相當高，但財政部會盡力而為。

櫃買中心昨（6）日公告，將放寬海外店頭市場非籌資型存託憑證（Level 1 ADR）之發行人條件，除富櫃50指數成分股之公司外，如最近3個月底市值排名皆為前100名且公眾流通量比率皆逾40％者，亦得發行Level 1 ADR，可望提升上櫃公司國際知名度。

櫃買中心表示，原本得發行Level 1 ADR之發行人須為櫃買中心富櫃50指數成分股之公司，經過本次放寬後，除富櫃50指數成分股之公司外，如最近三個月底市值排名皆為前10破盤0名且公眾流通量比率皆逾40％者，亦得發行Level 1 ADR，適度放寬發行人資格門檻。

去年底櫃買中心研議放寬Level 1 ADR之發行人條件，日前業獲主管機關同意，並將於近日公告實施，外國投資人投資我國上櫃公司管道新上市將更多，對於提升上櫃公司國際知名度及我國資本市場能見度有一定之助益。
